Section 161 Bharatiya Nyaya Sanhita, 2023

Abetting mutiny is punishable with :-

Death sentence or imprisonment for life and fine

Imprisonment for life or imprisonment upto ten years and fine

Imprisonment for life or imprisonment upto seven years and fine

Imprisonment upto ten years and fine

'A' is a soldier in Indian Army, his friend 'B' offers him partnership in his firm, and abets the desertion from Indian Army. 'B':-

has committed offence of Sedition

has committed offence of waging war

has committed abetment of desertion of soldier

Abetment of desertion of soldier is punishable with :-

Imprisonment for seven years or fine or both

Imprisonment for five years or fine or both

Imprisonment for three years or fine or both

Imprisonment for two years or fine or both

Harbouring a deserter is an offence punishable under Section 164 of Bharatiya Nyaya Sanhita, 2023. If harbour is given by a wife to her husband :-

she will be punished under Section 164

she may be punished at the discretion of Court

provision of Section 164 does not extend to spouse

punishment of wife will depend upon the facts and circumstances of the case
